To establish neglect, it must be proven that there is a “failure to provide, by those responsible for the care, custody, and control of the child, the proper or necessary support, education as required by law, nutrition or medical, surgical, or any other care necessary for the child’s well‑being.” Section 210.110(12), RSMo Supp. 2010.

Section 211.031.1(1), RSMo Supp. 2010, provides four distinct ways a neglect case may be pleaded. The first and most general is when the parents or persons legally responsible for the care and support of the child (defined as under 17 years of age, § 211.021(2), RSMo Supp. 2010, and § 211.031.1(1)), or of a person 17 years of age, neglect or refuse to provide proper support, education required by law, medical care, surgical care, or other care for the child’s well‑being.
