The Equal Pay Act of 1963 (EPA), 29 U.S.C. § 206, was enacted as an amendment to the Fair Labor Standards Act of 1938 (FLSA),
29 U.S.C. §§ 201 et seq., and it prohibits discrimination based on sex with respect to wages paid to employees who perform the same work. 29 U.S.C. § 206(d).
