XIV. (§6.86) An Ethical Dilemma
In many instances, the initial impetus for a trust contest is suspicion based on a lack of information. From the perspective of the “wronged” beneficiary, or hopeful beneficiary, the trust provisions just do not seem right. Often, the attorney who assisted the settlor is fully aware of the reasons for seemingly unusual trust provisions and could forestall a trust contest by sharing this information with the family and other interested persons.
