C. (§6.75) Statutory Defenses—Statute of Limitation

Because actions brought to contest or construe a trust are often subject not only to the equity jurisdiction of the circuit courts but also to the provisions of the Probate Code, the effectiveness of statutory defenses may prove difficult to determine. For example, in the case of statutes of limitations, a number of limitation periods may apply, ranging in length from 6 months to 22 years or even longer.
