1. (§6.34) Generally

Missouri courts have consistently held that violation of a statute or ordinance can be negligence per se. Eckert v. Thole, 857 S.W.2d 543 (Mo. App. E.D. 1993); Gipson v. Slagle, 820 S.W.2d 595 (Mo. App. W.D. 1991); Sirna v. APC Bldg. Corp., 730 S.W.2d 561 (Mo. App. W.D. 1987); Derboven v. Stockton, 490 S.W.2d 301 (Mo. App. W.D. 1972). According to the court in Eckert, the plaintiff in a negligence per se action must establish that:
