A. (§6.27) Application and Purpose

Subdivision, simply put, is the process of dividing a tract of land into two or more lots for purposes of development. Section 89.300(3), RSMo 2016. Control over the subdivision process by local authorities complements controls exercised through the zoning ordinance itself by addressing considerations such as:

appropriate layout;

need for and location of streets and utilities; and

other similar issues.

The subdivision process also presents the local government with an opportunity to ensure that applicable zoning regulations are being observed. In general, whereas zoning regulations regulate what may be done at a site, subdivision regulations focus on how it may be done.

Subdivision control is expressly authorized in the planning and zoning enabling legislation. Sections 64.060, 64.241, 64.580, 64.825, and 89.410, RSMo 2016. The statutes empower the local authority...
