b. (§6.20) Registration of Trusts

In at least one situation, exclusive jurisdiction seems to have clearly been delegated to the probate division—when a trust is registered.

Section 456.027, RSMo Supp. 2005, provides that a trustee—not a beneficiary—may register a trust “in the probate division of the circuit court of the county wherein the principal place of administration is located.” See §§ 456.1-103(16) and 456.1-108, RSMo Supp. 2005, for the definition of “principal place of administration of a trust.”...
