F. (§6.16) Amendments to Zoning Ordinance

The zoning ordinance initially adopted by a local authority may be amended from time to time on the authority’s own initiative or on application of a property owner for a “rezoning.” McCarty v. City of Kansas City, 671 S.W.2d 790 (Mo. App. W.D. 1984). A zoning change amendment under § 89.060, RSMo 2016, requires a public hearing and, if a legal protest duly signed and acknowledged before a notary public “by the owners of thirty percent or more, either of the areas of land . . . included in such proposed change or within an area determined by lines drawn parallel to and one hundred and eighty-five feet distant from the boundaries of the district proposed to be changed,” is received and certified before the vote of the municipality, “such amendment shall not become effective except by the favorable vote of two-thirds of all the members of the legislative body of such municipality.” Provisions of § 89.050, RSMo 2016, relative to public hearing and official notice and legal protest shall apply to all zoning changes or amendments of the zoning code.
