I. (§6.10) Procedure for Selling, Mortgaging, or Leasing Personal Property
A personal representative “has a right to and shall take possession of all the personal property.” Section 473.263.1, RSMo 2000. The procedure for the sale of personal property differs from the procedure for the sale of real property in that the court may not require notice of hearing on petitions to sell personal property. Moreover, the court does not require confirmation of the transaction, although a private sale, mortgage, or lease is not valid without the prior authorization or subsequent approval of the court.
