Like the family-based immigrant visas, the employment-based immigrant visas are subject to an annual cap by country and preference category. Once a Form I‑140 is filed, the U.S. Citizenship and Immigration Services will issue to the United States employer a receipt/priority date, which will be used to determine when the foreign national can process as a lawful/legal permanent resident in conjunction with the Visa Bulletin.
