Discharge in Violation of Public Policy

Missouri cases often categorize the actions that create a cause of action for wrongful discharge in violation of public policy into the following categories:

1. Refusing to perform an illegal act or an act contrary to a strong mandate of public policy

2. Reporting violations of law or public policy to superiors or public authorities (often referred to as the “whistleblower” cause of action)

3. Participating in acts encouraged by public policy, such as jury duty, seeking public office, or joining a labor union

4. Filing a worker’s compensation claim
