A party may file “exceptions” to the ALJ’s decision. If no party (respondent, General Counsel, or the charging party) files timely exceptions to the ALJ’s recommended decision and order, it automatically becomes final as an order issued by the Board.

If exceptions are filed, the case is transferred (or appealed) to the NLRB. Exceptions must be filed with the NLRB in Washington, D.C., within twenty-eight days from the date of the order transferring the case to the Board and must set forth specifically the...
