C. (§5.66) Jurisdiction and Venue

With the pervasive nature of media publications today, a Missouri resident may claim that the Missouri resident has been defamed by an out-of-state defendant. Because of the internet, many defamation suits involve out-of-state defendants who have posted something on an internet site.

In determining whether personal jurisdiction exists over a nonresident defendant, Missouri courts follow the Calder effects test, under which a plaintiff asserting specific jurisdiction over an out-of-state defendant must prove that the defendant’s acts were expressly aimed at the forum state and that the brunt of the injuries were felt in the forum state.
