B. (§5.6) Rules 17 and 88

The Supreme Court of Missouri has promulgated two rules dealing with alternative dispute resolution:

1. Rule 17, regarding establishment of an “early dispute resolution program” in lawsuits filed in the circuit division

2. Rule 88, which sets out procedures for mediation of child custody issues

These Rules are unique in that they only become effective upon adoption by a particular judicial circuit. Over the years since the adoption of these Rules, numerous circuit courts throughout Missouri have adopted mediation programs aimed specifically at child custody issues, with some circuits mandating mediation of these issues.
