A. (§5.29) Determining Title to Property

The personal representative has not completed the task of gathering estate assets until all money due the decedent and all property owned by the decedent are collected. It is sometimes necessary to institute a “discovery of assets” proceeding under § 473.340, RSMo 2000, to gather estate assets. Section 473.340 provides a mechanism for determining title to real or personal property that is:

· possessed by another person and claimed by the personal representative to be part of the estate; or
· possessed by the personal representative and claimed by another as that person’s own property.
