I. (§5.25) Uninsured Motorist Settlement

Because actions for personal injury or wrongful death are not assignable in Missouri, the method of settlement of uninsured motorist claims is a release and trust agreement. Reese v. Preferred Risk Mut. Ins. Co., 457 S.W.2d 205 (Mo. App. E.D. 1970). Under the terms of this agreement, the insured agrees to:

· release the insurance company from any further and additional actions under the uninsured motorist policy or policies involved;
