B. (§5.2) Need for a Record on Appeal

The record on appeal provides the appellate court with the framework for its understanding of what took place in the trial court and the errors that the appellant alleges occurred. It is the appellate court’s sole source of information about what happened at trial. The appellate court will not look beyond the record on appeal for facts necessary to resolve the issues that the case presents. Bd. of Pub. Utils. of City of Springfield v. Fenton, 669 S.W.2d 612, 614 (Mo. App. S.D. 1984). The appellate court will accept the record on appeal as true. If it does not accurately reflect the facts, corrections should have been made in the trial court. In re Marriage of Wright,990 S.W.2d 703, 707 (Mo. App. S.D. 1999).
