5. (§5.17) Surety Bonds
Courts will not recognize third-party beneficiary status when a surety bond specifically excludes a third party from coverage. Kansas City N.O. Nelson Co. v. Mid-W. Constr. Co. of Mo., Inc., 782 S.W.2d 672, 677 (Mo. App. W.D. 1989).
