The majority of cases arising under § 287.780, RSMo 1994, are premised on discharge in retaliation for exercising rights under The Workers’ Compensation Law, Chapter 287, RSMo. Retaliatory discharge under § 287.780 may take the form of constructive discharge when the employer forces the employee to quit by deliberately making the employee’s working conditions intolerable. Palermo v. Tension Envelope, 959 S.W.2d 825 (Mo. App. E.D. 1997).
