Cities having a population over 5,000 inhabitants and counties
over 85,000 population can adopt home rule charters. Mo. Const. art. VI, §§ 18(a) and 19. These charters can set out a procedure
for the exercise of eminent domain. Rule 86.01. If the charter does
not declare the condemnation Rule 86 inapplicable, the parties must comply with the provisions of the Rule. Bueche v. Kansas City, 492 S.W.2d 835 (Mo. banc 1973).
