§ 4.9.10 Appeals to the U.S. Court of Appeals

An appeal to the U.S. Court of Appeals for the Federal Circuit can be made by either by the contractor or the government. Notice of Appeal must be filed with the Clerk of the Court of Federal Claims after entry of a final judgment. An appeal from a board decision must be filed with the Clerk of the Federal Circuit after entry of the board decision. The appeals must be filed within the time limits established in the respective Court’s appellate rules, including any extensions of time through filing post-judgment motions.
