Section 537.095, RSMo 2000, states that, if two or more persons are entitled to bring a wrongful death suit, court approval is required to settle the claim. A simple release might be sufficient under the law if there is only one beneficiary, but as a practical matter, and because counsel should always be worried that an unknown class member may appear, the procedures outlined in § 537.095 should probably be followed with one known beneficiary, just as they would be with more than one beneficiary.
