D. (§4.7) Jurisdiction
Based on the plain language of the statutes and the fact that Rule 85.02 speaks of "a civil action," attachment is available in any civil case involving a "legal" claim. In cases commenced before an associate circuit judge, attachment is also available. In these cases, the Rules of Civil Procedure are applicable as incorporated under § 517.021, RSMo 2000. See Robert S. Cohen, Civil Practice Before Associate Circuit Judges Since the Court Reform, 37 J. MOBAR 217 (1981).
