3. (§4.40) Trial Motions
Consideration of whether to file certain trial motions differs depending on whether the matter is tried to a jury. Rule 72.01 governs motions for directed verdict and judgment notwithstanding the verdict in a jury trial. Time should be spent to raise all anticipated issues of error in these motions in case an appeal becomes necessary. Lockwood v. Jackson County, Mo., 951 S.W.2d 354 (Mo. App. W.D. 1997).
