2. (§4.4) Nominal

In Missouri, a plaintiff’s inability to prove actual damages in its breach of contract claim does not negate the element of damages on that claim. Hanna v. Darr, 154 S.W.3d 2 (Mo. App. E.D. 2004). Proof of the existence of a contract and its breach is sufficient to give rise to at least nominal damages, even if the plaintiff has not suffered any actual damages or is unable to prove such damages at all or to the degree of certainty required under the law.
