d. (§4.39) Motion for Judgment on the Pleadings

A trial court may properly grant a motion for judgment on the pleadings if, from the face of the pleadings, the moving party is entitled to a judgment as a matter of law. State ex rel. Nixon v. Am. Tobacco Co., 34 S.W.3d 122 (Mo. banc 2000). Motions for judgment on the pleadings are proper after the answer has been filed and the pleadings are, in essence, closed. Rule 55.27(b); Bramon v.
