XIV. (§4.39) Contractors’ Pollution and Consultants’ Environmental Liability Insurance

With most of the insurance coverage that has been addressed in this chapter, including the commercial general liability (CGL) policy, containing either a limited or broad pollution exclusion, a party to construction work will need to consider how to insure its pollution risks. Contractors directly involved with projects that have a pollution exposure, especially remediation projects, need broader pollution liability insurance coverage than provided by the aforementioned insurance. Pollution coverage can be afforded through an endorsement available under a CGL policy, a contractor’s pollution liability (CPL) insurance policy, or a consultant environmental liability (CEL) insurance policy, the latter of which is usually procured by an engineering firm.
