1. (§4.34) Generally

There are a variety of motions that may be asserted. Rules 55.27 and 74.04 govern many of the available motions. Some questions to consider in deciding whether to file or oppose motions are:

· What is the standard required to win on moving or opposing the motion?

· What form is required for the motion?

· Can matters outside the pleadings be attached or discussed?

· What are the appeal issues involved?

· If successful on motion at trial court level, can opponent appeal?
