4. (§4.34) Arbitration Agreements

Unless authorized by statute, courts have been reluctant to grant specific enforcement of contracts to arbitrate. Jenks v. Jenks, 385 S.W.2d 370 (Mo. App. E.D. 1964). Under the Uniform Arbitration Act, §§ 435.350–435.470, RSMo 2000, enacted by the Missouri legislature in 1980, arbitration agreements covered by that Act are now specifically enforceable.
