J. (§4.33) Amended Pleadings

Once a responsive pleading is served, a pleading may be amended only by leave of court or by the written consent of the adverse party. Rule 55.33; Curnutt v. Scott Melvin Transp., Inc., 903 S.W.2d 184 (Mo. App. W.D. 1995). A party does not have an absolute right to file an amended pleading. Kanefield v. SP Distrib. Co., L.L.C., 25 S.W.3d 492 (Mo.
