Section 4.2 When Depositions May Be Taken

Rule 57.03(a) permits depositions to be taken at any time after an action commences, except that leave of court must be obtained when:

·the deponent is confined in prison; or

·a plaintiff desires to take a deposition within 30 days after service of summons and petition on any defendant, unless the defendant to be deposed has given notice of taking depositions or otherwise sought discovery.

The 30-day period begins to run with service upon any defendant, and service upon all defendants is not apparently...
