A. (§4.2) Instruction
Generally, when approved instructions are available in Missouri, "such instruction must be given to the exclusion of all others." Karashin v. Haggard Hauling & Rigging, Inc., 653 S.W.2d 203, 206 (Mo. banc 1983). MAI instructions "are authoritative if applicable to the factual situation" and bind the trial court and appellate court "as surely as it is bound by Supreme Court cases and rules." Lindsay v. McMilian, 649 S.W.2d 491, 493–94 (Mo. App. W.D. 1983).
