In the class 3 category, the mode of distribution creates additional requirements. Unlike the situation in which two or more people exist in either class 1 or class 2, in the case of a plaintiff ad litem, “the persons entitled to share” are determined in accordance with the laws of descent and distribution, and settlement “shall likewise be distributed . . . unless special circumstances indicate that such a distribution would be inequitable.” Section 537.095.2, RSMo 2000.
