Section 4.18 Persons Before Whom Depositions Are Taken

Rule 57.05(a)–(c) designates the persons authorized to take depositions. Generally, depositions may be taken before a person authorized to administer oaths where the deposition is to be taken or before a person appointed by the court in which the action is pending. The deposition may not be taken before a person who:

· is a relative or an employee of any of the parties or their attorneys;

· is an attorney for any of the parties; or

· has a financial interest in the action.
