C. (§4.18) Bond

Section 521.050, RSMo 2000, specifically states that a bond is necessary unless the defendant is not a resident of Missouri or the claimant is the state or a county suing on its own behalf. Missouri courts have consistently held that the statutory bond requirement is a mandatory condition to a plaintiff maintaining an action in attachment and to the court obtaining jurisdiction to enter a writ of attachment. State ex rel. Webster County v. Hutcherson, 199 S.W.3d 866, 875 (Mo. App. S.D. 2006); State ex rel. Froidl v. Tillman, 662 S.W.2d 907, 908 (Mo. App. E.D. 1983); State ex rel. Belle Starr Saloon, Inc. v. Patterson, 659 S.W.2d 789 (Mo. App. E.D. 1983).
