Both the statute, § 407.020.1, RSMo Supp. 2012, and Missouri courts have consistently stated that the elements of an MPA violation are “the act, use or employment of” one or more of the following:

· deception, defined in 15 CSR §§ 60-9.020(1) and 60-9.030;

· fraud, defined in 15 CSR §§ 60-9.040 and
60-9.100;

· false pretense, defined in 15 CSR § 60-9.050;

· false promise, defined in 15 CSR § 60-9.060;

· misrepresentation, defined in 15 CSR §§ 60-9.070, 60-9.080, and 60-9.090;

· unfair practice, defined in 15 CSR §§ 60-8.020(1)(A) and 60-8.090(1); and

· concealment suppression or admission of any material fact, defined in 15 CSR §§ 60-9.010(C) and 60-9.110,

in connection with:

· the sale, defined in § 407.010(6), or advertisement, defined in § 407.010(1);

· of any merchandise, defined in § 407.010(4);

· in trade or commerce, defined in § 407.010(7);

· resulting in an ascertainable loss of money or real or personal property to a person who purchases...
