While a discussion of petroleum storage tanks is outside of the scope of this chapter, some mention of the Missouri Petroleum Storage Tank Insurance Fund, § 319.129, RSMo Supp. 2001, is relevant, at least to the extent that it is a source of possible funding for site remediation. Petroleum contamination is not easily addressed because this contamination is not considered hazardous under CERCLA, and it is difficult, at best, to assert a RCRA claim against another party, including prior owners.
