In McGhee v. Dixon, 973 S.W.2d 847 (Mo. banc 1998), the Court reversed that part of Wolf v. Missouri State Training School for Boys, 517 S.W.2d 138, 144–45 (Mo. banc 1974), holding that the employee could offset his outside earnings with his attorney fees and expenses. The only avenue for the prevailing employee to obtain fees and expenses is application through the Missouri equal access to justice law, §§ 536.085 and 536.087, RSMo 2000. See Chapter 26
