There are a number of issues relating to the transaction involving a contaminated piece of property. Nontransactional Brownfields issues are discussed above. With respect to contaminated property, the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA), 42 U.S.C. §§ 9601, et seq., poses the greatest risk of liability to the parties in any business transaction. While CERCLA is the subject of Chapter 9 of this deskbook, it is appropriate to briefly review the statute.
