Under the MMW Act, a written warranty must be one of
two things:
1. A written factual statement or promise that the product’s material or workmanship is defect free or will perform at a specified level of performance for a specified time
2. A written promise to refund, repair, replace, or take other remedial action with respect to a product if the product fails to meet the promised specifications
