Section 34 When Manufactured Homes Become Affixed to Real Estate

Unlike all other forms of collateral considered in this chapter, a manufactured home may become real property. One manner of converting it from personal property to realty is to comply with the requirements of § 700.111, RSMo 2000, including setting the manufactured home on a permanent foundation and removing the axles, wheels, and hitches. When these things are done, the manufactured home is thereafter considered realty for property tax purposes. Id. For the purposes of secured transactions, the manufactured home would seem to become a “fixture.” See § 400.9-102(41), RSMo Supp. 2004. Another manner would be to satisfy the three-fold test found in Missouri common law:
