The following is a checklist of some of the critical points to watch in bringing suits to quiet title:

1. Ascertain the legal position of the client or clients in respect to the real estate.

2. Obtain an accurate legal description of the real estate.

3. Include all persons as defendants who may or could have any claim, right, or title to the real estate in question and include all parties whose land may infringe on any part of the land in suit.

4. Make a diligent effort to ascertain the names and whereabouts of all defendants.

5. Prepare a petition for suit to quiet title setting forth the basis for the clients’ right to the property.
