Attachment of security interests in manufactured homes that are personal property under Missouri law occurs by means of a notice of lien, just as with motor vehicles. Sections 400.9-303(e) and 700.350.2, RSMo Supp. 2004. But there may have been a short period just after enactment of the Missouri version of Revised Article 9 in which the lien perfection provisions of § 700.350.2 were not the sole means of perfecting such liens.
The section of Article 9 that should list all certificate of title statutes as exceptions to the requirement for filing financing statements, § 400.9-311(a)(2), RSMo Supp. 2004, has never listed the statutes for watercraft or manufactured homes as exceptions. That section...
