A provision prohibiting certain acts by drivers of commercial vehicles in §302.780 (amended) was moved into the offense of driving with an excessive BAC without a change in penalty. In the Revised Code, a person comm its driving with an excessive BAC if that person operates a vehicle while having a BAC of .08 percent or more or operates a commercial motor vehicle while having a BAC of .04 percent or more.
