Section 3 Notice of Intent to Take

Now, at least 60 days before filing a condemnation petition, the condemning authority must provide the owner of record with a written notice concerning the intended acquisition unless the property owner expressly waives this right in writing. Section 523.250, RSMo Supp. 2008.

Section 523.250.1 requires that the notice provide the following information:

(1) Identification of the interest in real property to be acquired and a statement of the legal description or commonly known location of the property;
