In assessing legal claims by an employee against the employer arising out of workplace violence suffered by the employee, the first issue to consider is the impact of The Workers’ Compensation Law, Chapter 287, RSMo. It may provide a remedy against the employer, but it may also preclude a more lucrative common-law action against the employer because of the exclusivity of the workers’ compensation remedy.
