Employees are eligible if they have worked for a covered employer for at least twelve months and for at least 1,250 hours over the immediately preceding twelve months. Moore v. Payless Shoe Source, Inc., 139 F.3d 1210 (8^th Cir. 1998); 29 U.S.C. § 2611(2)(A). There must also be at least fifty employees within seventy-five miles of the employee’s worksite. Muller v. Hotsy Corp., 917 F. Supp. 1389 (N.D. Iowa 1996); 29 U.S.C. § 2611(2)(B)(ii). The seventy-five-mile requirement is usually measured using surface transportation over public roads by the shortest route. 29...
