The FMLA covers private employers that employ at least 50 employees for each working day during each of at least 20 calendar weeks in the current or preceding calendar year. 29 U.S.C. § 2611(4).

Any public agency, as defined in the Fair Labor Standards Act of 1938 (FLSA), 29 U.S.C. §§ 201 et seq., is also an “employer” covered under the FMLA. 29 C.F.R. § 825.108(a); see 29 U.S.C. § 203(d) and (x). Examples would be:
