5. (§3.43) Conflict Not Presumed in Certain Investments
Section 456.8-802.6, RSMo Supp. 2005, sets forth two transactions that are not to be presumed to be a conflict between the trustee’s personal and fiduciary interests provided that the trustee’s transactions have complied with the Missouri Prudent Investor Act, §§ 469.900–469.913, RSMo Supp. 2005. Those transactions are:
(1) An investment by a trustee in securities of an investment company or investment trust to which the trustee, or its affiliate, provides services in a capacity other than as trustee.
