VI. (§3.23) Wrongful Garnishment and Wrongful Discharge
Missouri courts recognize actions for "wrongful garnishment," but the plaintiffs do not appear to have been notably successful. See, e.g., Moon v. Tower Grove Bank & Trust Co., 691 S.W.2d 399 (Mo. App. E.D. 1985); Linsin v. Transp. Ins. Co., 691 S.W.2d 393 (Mo. App. E.D. 1985). More often, it appears, the appropriate action would be based on abuse of process, conversion, malicious prosecution, or a similar tort.
